Medical Negligence Claims

I would like to talk to you about medical negligence claims.  In this country, statistics bare out that there are a lot of individuals who are injured due to negligent care by a medical professional.  Each state normally has a specific statute on medical malpractice.  Let me tell you a couple of important things to remember.

In Ohio, there one year statute limitation to date.  What that means is that if you do not file a law suit within that one year period of time, your claim maybe barred forever.  Now, there are a lot of rules on how that date works and when it runs.  The important thing to remember is, if you have been a victim of medical negligence, you need to seek legal help as soon as possible. because you only have a year to get that law suit filed.  Now, what you should you do if you think you are the victim of medical negligence?

Well, first thing is keep a diary.  Mark down everything that occurs.  Everything that occurs, everything the doctor or the medical professional says.  Get copies of all of your medical records.  Every record you can think off, from the hospital, from the doctor, from the physical therapist, anyone that you have seen for that medical condition.  Also get witness statements. There are other people around who heard the doctor say something or saw something, make sure you get their names.  A lot of this stuff can disappear pretty quickly.  Now, what do you have to show?

Well for a medical negligence claim, you have to show that the doctor’s treatment fell below accepted medical practice standards for that community.  What does that mean in layman’s terms?  You basically have to show that the doctor was negligent in your care.  How do you do that?  Well, the best way to do that, and pretty much the only way, is you need a testimony from a similar position. You need someone who will testify that the doctor, medical facility, the nurse, the physical therapist, or the EMT that conduct your treatment fell below accepted practices and that they were negligent.  In order to file a law suit in Ohio, you have to have an affidavit from a doctor.
